This Privacy Policy for Personal Data (hereinafter referred to as the Privacy Policy) applies to all information that the Internet Store 'FITCRUSH', located at https://fitcrush.com.ua/, may obtain about the User during the use of the Internet Store website, programs, and products.
1. DEFINITION OF TERMS
1.1 In this Privacy Policy, the following terms are used:
1.1.1. 'Site Administration of the Internet Store (hereinafter - Site Administration)' - authorized employees responsible for managing the website on behalf of the FITCRUSH online store, organizing and processing personal data, as well as determining the purposes of processing personal data, the composition of personal data subject to processing, actions or operations performed with personal data.
1.1.2. 'Personal data' - any information directly or indirectly related to an identified or identifiable individual (personal data subject).

5. METHODS AND TERMS OF PERSONAL INFORMATION PROCESSING
5.1. The processing of the User's personal data is carried out without any time limitations, by any legal means, including in personal data information systems using automation tools or without using such tools.
5.2. The User agrees that the Administration of the website has the right to transfer personal data to third parties, including courier services, postal organizations, and telecommunication operators, solely for the purpose of fulfilling the User's order placed on the FITCRUSH Internet Store website, including the delivery of goods.
5.3. The User's personal data may be transferred to authorized state authorities of Ukraine on grounds and in the manner established by Ukrainian legislation.

6. OBLIGATIONS OF THE PARTIES
6.1. The User is obliged to:
6.1.1. Provide information about personal data necessary for using the FITCRUSH Internet Store website.
6.1.2. Update and supplement the provided information about personal data in case of changes to this information.
6.2. The website Administration is obliged to:
6.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.
6.2.2. Ensure the confidentiality of the information, not to disclose, without the prior written permission of the User, as well as not to sell, exchange, publish, or disclose in any other possible way the transferred personal data of the User, except for clauses 5.2. and 5.3. of this Privacy Policy.
6.2.3. Take preventive measures to protect the confidentiality of the User's personal data in accordance with the procedure commonly used to protect such information in the existing business practices.
6.2.4. Block the User's personal data from the moment of the User's request or inquiry, or from the moment of the User's legal representative or authorized body for the protection of the rights of personal data subjects, for the period of verification, in case of identifying inaccurate personal data or unlawful actions.
7. RESPONSIBILITY OF THE PARTIES
7.1. The website Administration, failing to fulfill its obligations, is responsible for the damages incurred by the User due to the unlawful use of personal data, in accordance with the legislation of Ukraine, except for cases specified in clauses 5.2., 5.3., and 7.2. of this Privacy Policy.
7.2. In the event of loss or disclosure of Confidential Information, the website Administration is not liable if such confidential information:
7.2.1. Became public domain before its loss or disclosure.
7.2.2. Was obtained from a third party before receiving it by the website Administration.
7.2.3. Was disclosed with the User's consent.
8. DISPUTE RESOLUTION
8.1. Before filing a lawsuit regarding disputes arising from the relationship between the User of the FITCRUSH Internet Store website and the website Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim informs the claimant in writing of the results of the claim consideration within 30 calendar days from the date of receiving the claim.
8.3. In case of failure to reach an agreement, the dispute will be referred to the court in accordance with the current legislation of Ukraine.
8.4. This Privacy Policy and the relationship between the User and the website Administration are governed by the current legislation of Ukraine.
9. ADDITIONAL TERMS
9.1. The website Administration has the right to make changes to this Privacy Policy without the User's consent.
9.2. The new Privacy Policy comes into effect upon its publication on the FITCRUSH Internet Store website unless otherwise provided by the new version of the Privacy Policy.
